The FTX App PlayStation 5 Sweepstakes (“Sweepstakes) begins at 10:00 AM Eastern Time (“ET”) on June 24, 2022 and ends at 5:00 PM ET on July 24, 2022 (the “Sweepstakes Entry Period”). Sponsor’s clock shall be the official timekeeper.
Eligibility:To be eligible for this Sweepstakes, at the time of participation you must be legal resident of the fifty (50) United States and Washington, D.C. (“Territory”) who is eighteen (18) years of age or older (except in the case of legal residents of certain states where the legal age of majority is greater than eighteen (18) years of age, such legal age of majority) at the time of entry (the “Entrant” or “You”). Entrant cannot be an employee of Nerd Street Gamers, Inc. (the “Sponsor”) or have been employed by Sponsor within the last twelve months) or be an employee nor members of their households or immediate families whether related or not, and all such individuals are not eligible to participate. "Household members" shall mean people who share the same residence at least three months a year. "Immediate family members" shall mean parents, stepparents, children, stepchildren, siblings, stepsiblings, or spouses.
How to Enter.
There are two (2) ways to enter the Sweepstakes:
- Method 1: The Entrant may enter the Sweepstakes during the Sweepstakes Entry Period by scanning the unique QR code to sign up for the FTX App (https://apps.apple.com/us/app/ftx-crypto-exchange/id1095564685).
- Method 2: The Entrant may enter the Sweepstakes during the Sweepstakes Entry Period by using the referral code “NERD” when signing up for the FTX app (https://apps.apple.com/us/app/ftx-crypto-exchange/id1095564685).
- Method 3: During the Sweepstakes Entry Period, hand print your full name, phone number, email address, and date of birth on a 3 x 5 inch piece of paper and insert such piece of paper to a box labeled “FTX PLAYSTATION AMOE” located at Localhost Philly, located at 401 N Broad Street, Philadelphia, PA.
**No fee is required to enter the Sweepstakes using Method 1, Method 2, or Method 3
**You may only sign up a maximum of one (1) time during the Sweepstakes. You will receive one (1) Entry per sign-up.
Random Drawing and Potential Winner (referred to hereafter as a “Winner”) Notification: Winners will be selected via a random drawing on or about on July 25, 2022 by the Sponsor whose decisions are final and binding. The Winner will be notified by email or phone call within two (2) business days after the random drawing by the Sponsor and will be required to : (a) complete, sign and return an Affidavit of Eligibility & Release of Liability, and where permissible, a Publicity Release (collectively the “Affidavit”), and (b) complete and submit a W-9 Form (collectively, “Winner Verification Documents”) within five (5) days of date specified on notification, or an alternate Winner may be selected at Sponsor’s sole discretion. If an email notification is returned as undeliverable, or if a Winner fails to submit his or her complete Winner Verification Documents within the time allocated, or if any Winner cannot accept prize for any reason, or if he or she is not in compliance with these Official Rules, including but not limited unable to provide proof of being a student per the eligibility requirements of these Official Rules, corresponding Winner will be disqualified, and the prize may be awarded to an alternate Winner at the Sponsor’s sole discretion. Entry and acceptance of prize constitute permission to use the Winner's name, prize won, hometown and likeness for online posting and promotional purposes without further compensation, permission or notification, except where prohibited by law.
Prize:One (1) PlayStation 5 with total value of $$499.99 USD.
No substitutions, transfers or assignments of prize permitted. The Winner will be responsible for all federal, state, local, income or any other taxes associated with winning the prize and an IRS Form 1099 will be filed in the name of the Winner for the prize won.
The Prize is AS-IS and does not include any travel, accommodations or other expenses that the Prize winner may incur in connection with the acceptance of the Prize.

DISCLAIMER. THE PRIZE PRESENTED “AS-IS.” SPONSOR EXPRESSLY DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, GUARANTEES, AND REPRESENTATIONS WITH RESPECT TO THE PRIZE, INCLUDING, WITHOUT LIMITATION, THE PRIZE’S QUALITY OR FITNESS FOR A PARTICULAR PURPOSE.
Odds:Odds of winning are dependent on the total number of eligible entries received during the Sweepstakes Entry Period.
Consent and Release: To the fullest extent possible in law, Entrants, on behalf of themselves and on behalf of their respective heirs, executors, administrators, legal representatives, successors and assigns (“Releasing Parties”), release, defend and hold harmless the Sponsor or its shareholders, directors, subsidiaries, affiliates, officers, employees, agents, partners, distributors, service providers, landlords, property managers and licensors (individually and collectively, "Released Parties”) from any and all actions, causes of action, suits, debts, dues, sums of money, accounts, reckonings, bonds, bills, specialties, covenants, contracts, controversies, agreements, promises, variances, trespasses, lost profits, indirect or direct damages, consequential damages, incidental damages, punitive or exemplary damages, judgments, extent, executions, claims and demands whatsoever, in law, admiralty or equity, whether known or unknown, foreseen or unforeseen, against Released Parties which any one or more of the Releasing Parties ever had, now have or hereafter can, shall or may have which in any way arise out of or result from Entrant’s participation, acceptance and use or misuse of prize (if Entrant is determined a Winner). The Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of prize. In the event Sponsor is prevented from continuing with the Sweepstakes as contemplated herein by any event beyond its control, or otherwise, including but not limited to fire, flood, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal, state, or local government law, order, or regulation, or order of any court, or other cause, Sponsor shall have the right to modify, suspend or terminate the Sweepstakes. Furthermore, the Sponsor reserves the right to terminate the Sweepstakes if it becomes technically corrupted (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Sweepstakes), and to determine the Winner from among all eligible entries received prior to termination. Entrants assume all liability for any injury, including death or damage caused or claimed to be caused, by participation in this Sweepstakes or use or redemption of the prize (if Entrant is determined to be a Winner).
Arbitration: This Sweepstakes shall be governed by and interpreted under the laws of laws of the Commonwealth of Pennsylvania, United States of America (including its statutes of limitations), without giving effect to the conflict of laws provisions thereof to the extent such principles or rules would require or permit the application of the laws of any jurisdiction other than those of the Commonwealth of Pennsylvania. You hereby agree that any and all disputes, claims, causes of action, or controversies (“Claims”) arising out of or in connection with this Sweepstakes shall be resolved solely by binding arbitration. Arbitration shall be administered exclusively by JAMS in Philadelphia County, Pennsylvania and shall be conducted consistent with the rules, regulations, and requirements thereof as well as any requirements imposed by state law. Any arbitral award determination shall be final and binding upon the Parties. NEITHER PARTY WILL HAVE THE RIGHT TO LITIGATE THAT CLAIM IN COURT OR HAVE A JURY TRIAL ON THAT CLAIM. FURTHER, THE SWEEPSTAKES ENTRANTS WILL NOT HAVE THE RIGHT TO PARTICIPATE IN A REPRESENTATIVE CAPACITY ON BEHALF OF THE GENERAL PUBLIC OR OTHER PERSONS SIMILARLY SITUATED, OR AS A MEMBER OF ANY CLASS OF CLAIMANTS PERTAINING TO ANY CLAIM SUBJECT TO ARBITRATION. EXCEPT AS SET FORTH BELOW, THE ARBITRATOR’S DECISION WILL BE FINAL AND BINDING. NOTE THAT OTHER RIGHTS THAT THE SWEEPSTAKES ENTRANT WOULD HAVE IF THE SWEEPSTAKE ENTRANT WENT TO COURT ALSO MAY NOT BE AVAILABLE IN ARBITRATION. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES. THE SWEEPSTAKE ENTRANT HEREBY WAIVES ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF THE SWEEPSTAKES ENTRANT, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE. The arbitrator’s authority to resolve Claims is limited only to Claims between Sponsor, on the one hand, and the Sweepstakes Entrant, on the other hand, and the arbitrator’s authority to make awards is limited only to awards to Sponsor, on the one hand, and the Sweepstakes Entrant, on the other hand. Furthermore, claims brought by either party against the other hereunder may not be joined or consolidated in arbitration with Claims brought by or against any third party, unless agreed to in writing by all parties. No arbitration award or decision will have any preclusive effect as to issues or claims in any dispute with anyone who is not a named party to the arbitration.
General: Sponsor is not responsible for: (a) incorrect or inaccurate transcription of entryinformation or late, lost, stolen, unintelligible, illegible, damaged, mutilated, altered, incomplete, misdirected orpostage due entries or entries received through impermissible or illegitimate channels, all ofwhich willbedisqualified; (b) technical failures of any kind, including but not limited to the malfunctioning of any telephone,computer online systems, computer equipment, website, serverprovider, network, hardware or software; (c)the unavailability or inaccessibility of any website or service; (d) unauthorized intervention in any part of theentryprocessortheSweepstakes;(e)printing,typographical,electronicorhumanerrorswhichmayoccurintheoffer or administration of the Sweepstakes or the processing of entries; or (f ) any injury or damageto personsor property, including but not limited to entrant’s computer or phone, which may be caused, directly or indirectly, in wholeorinpart,fromentrant’sparticipationintheSweepstakes,orfromviewing, partaking,ordownloadinganymaterialfrom the FTX app regardless of whether thematerialisconnectedtoSponsor’sreferral code.
***Any transaction the Entrant makes on the FTX app are at Entrant’s own risk. Sponsor is not responsible for any transaction Entrant makes on the FTX app. Entrant is solely responsible for determining the appropriateness of using the FTX app. All transactions on the FTX app are subject to the FTX privacy policy (https://help.ftx.us/hc/en-us/articles/360043578593-Privacy-Policy) and the FTX User Agreement (https://ftx.us/TermsOfService.pdf).
By participating in the Sweepstakes, Entrants (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor, which are final and binding in all matters relating to the Sweepstakes. Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or violates these Official Rules. LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY INTERFERE WITH THE OPERATION OF THE SWEEPSTAKES, IS A VIOLATION OF CRIMINAL & CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

Privacy: By entering the Sweepstakes, the information Entrants provide may be sent to promotional partners. Entrants may be contacted by the Sponsor and/or any promotional partners with future promotional offers.
